General Terms and Conditions for Events and Seminars

1. Scope of application

These general terms and conditions apply to all events and seminars (hereinafter referred to as “seminar events”) organized by THOST Projektmanagement GmbH (hereinafter referred to as “THOST”). They apply equally to consumers and companies, unless otherwise specified.

2. Registration and conclusion of contracts

You can register for a seminar event online at www.thost.de/veranstaltungen by completing and sending the online registration form or by filling out the registration form from the seminar brochure sending it by fax or e-mail to:

By registering, the participant accepts these general terms and conditions as an integral part of the contract.

The contract for participation in the seminar is concluded upon receipt of the confirmation of registration, which is sent by e-mail to the address given at the time of registration. In the event of overbooking, the applicant will be informed immediately and the contract for participation in the seminar will not be concluded.

Upon receipt of the invoice, the seminar price including statutory VAT is due for payment in full to one of the accounts specified in the invoice.

3. Scope of services

The nature and scope of the seminar services are set out in the service description of the respective seminar event in the seminar brochure and/or the seminar description on the website www.thost.de/veranstaltungen. Minor deviations in content are permissible.

4 Cancellation by participants, substitute participants

The participant may cancel the contract for participation in the seminar at any time up to the start of the event. Cancellation is possible free of charge up to 4 weeks before the start of the event; any seminar price already paid will be refunded. In the event of a later cancellation, the seminar price will be charged in full; this also applies in the event of non-attendance or discontinuation of participation. Cancellation must be made in text form to the contact details given in Section 2. The date of receipt of the declaration of withdrawal by THOST is decisive for compliance with the deadline. The participant is at liberty to prove that THOST has not incurred any damage or not in the amount claimed.

A transfer of the right to participate to a substitute participant is possible at any time by submitting a declaration to THOST.

5 Cancellation of event by THOST

THOST reserves the right to cancel an event in the event of force majeure, insufficient demand or number of participants or for other important reasons for which THOST is not responsible (e.g. sudden illness of the speaker). THOST will inform the participants of this immediately. In such a case, any seminar fees already paid will be refunded in full. Further claims of the participants, in particular claims for damages as a result of already booked transportation and accommodation services, shall only exist in accordance with the provisions set out in section 6.

6. Liability

THOST shall only be liable for damages within the scope of the statutory provisions in accordance with the following provisions.

THOST is liable for damages resulting from injury to life, body or health as well as for damages caused by intent or gross negligence on the part of the organizer or its vicarious agents.

THOST is liable, limited to compensation for foreseeable, typically occurring damages, for such damages that are based on a slightly negligent breach of a material contractual obligation by THOST or its vicarious agents. Essential contractual obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely.

Other claims for damages by participants are excluded. The provisions of the Product Liability Act remain unaffected.

THOST accepts no liability for the content of the seminar presentations or the accompanying work documents.

The limitations of the above provisions also apply in favor of THOST’s legal representatives and vicarious agents if claims are asserted directly against them.

7. Data protection

Personal data will be treated confidentially and processed by THOST exclusively in the context of event and contract processing and in accordance with the applicable data protection regulations. Disclosure to third parties is excluded.

8. Copyright

The material accompanying the events is protected by copyright and may not be reproduced or distributed without THOST’s explicit consent.

9. Dispute resolution / online dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found on the Internet at ec.europa.eu/consumers/odr/. THOST is not obliged to participate in a dispute resolution procedure before a consumer arbitration board and will not participate in such a procedure.

10. Cancellation policy for consumers

Right to withdraw

The participant has the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

To exercise the right of withdrawal, THOST (THOST Projektmanagement GmbH, Villinger Straße 6, 75179 Pforzheim, phone: +49 7231 1560-0, fax: +49 7231 1560-90, e-mail: experts@thost.de) must be informed of the decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). The attached sample withdrawal form can be used for this purpose.

To comply with the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.

 

Consequences of cancellation

If you withdraw from this contract, we shall reimburse you with all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this repayment.

 

Withdrawal form

If you wish to cancel the contract in accordance with the above cancellation policy, you can complete this form and return it to us. However, the use of the form is not mandatory.

11. final provisions

Should one or more provisions of this agreement be ineffective or invalid or contain a loophole, this shall not affect the validity of the remaining provisions. The invalid or ineffective provisions shall be interpreted or replaced in such a way that they correspond as closely as possible to the intended purpose of this agreement. The same shall apply in the event of a loophole.

If the participant is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, Pforzheim is agreed as the exclusive place of jurisdiction for all disputes arising from or in connection with this contract. If the participant has no general place of jurisdiction in the Federal Republic of Germany, Pforzheim shall be the non-exclusive place of jurisdiction. If the participant moves his/her place of residence or habitual abode outside Germany after conclusion of the contract or if his/her place of residence or habitual abode is not known at the time the action is brought, the place of jurisdiction for actions against the participant(s) shall be Pforzheim. Otherwise, the statutory places of jurisdiction shall apply. Exclusive places of jurisdiction, e.g. for judicial dunning proceedings, remain unaffected.
