Project contracts often arise under high competitive and deadline pressure and are characterized by their complexity. In an international environment, there are also country-specific peculiarities. The involvement of many parties with different interests and dynamic change processes further increase the requirements. In this area of conflict, deviations from the contract can arise that affect deadlines and costs and significantly jeopardize the success of the project.

Efficient contract management and contract controlling are required to meet these challenges. Our Contract & Claims Management (CCM) team systematically identifies contract deviations as well as opportunities and risks. Contract Guidelines

Contract guidelines summarize all key contractual content in a clear and precise manner. Precise knowledge of performance targets, contract deadlines, obligations and rights, processes and procedures as well as knowledge of opportunities and risks enable strategic and targeted action.

Claims management

Claims management identifies situations and events that deviate from the contract, clarifies responsibilities and the basis for claims, ensures compliance with formal requirements, evaluates, negotiates and documents either during the project or in individual claims. Our proactive claims management creates negotiating positions for the defense or enforcement of claims. This enables early, preventative corrections, helps to avoid conflicts and contributes to the profitability of projects.

Forensic Contract & Claims Management

Clarification of the facts

The aim of the forensic CCM is initially to clarify the facts in order to be better equipped for negotiations, to assess whether further escalation is worthwhile and to be able to take countermeasures in the project. This is based on the available project information.
We provide support through:

  • Analysis of contracts, supplements, change notifications and expert opinions
  • Evaluation of documents, minutes, e-mails and letters
  • Identification of deviations in plan revisions, drawings or other engineering documents
  • Consultation of knowledge holders

The result is a report that answers the following questions:

  • What happened?
  • When did it happen?
  • Why did it happen?
  • What is the reason for the deviation from the (contractual) target?
  • Who is responsible for it?
  • What are the consequences that can be communicated?

We clarify whether the BIM planning service provided corresponds to the contractually owed performance target – from simple consulting or plausibility checks to complex expert reports.

A comprehensible, formally correct and convincing fee proposal and a verifiable invoice are necessary to ensure that you receive the fee you deserve after the assignment. We will be happy to prepare these for you and carry out invoice plausibility checks or complex fee appraisals by an expert.

Assessment of opportunities and risks

The more complex the contracts, the more difficult it is to manage them. We support you right from the contract initiation phase and point out technical risks and opportunities. During the course of the project, we take over contract and claims management in order to make the best possible use of opportunities in your interests and avert risks and claims from your contractual partners.
